Facts

Mr Ibrahim Aziz, a Turkish Cypriot resident in the government-controlled areas, applied on 30 January 2001 to be entered on the electoral roll for the 27 May 2001 parliamentary election and was refused on the basis of Article 63 of the Constitution. On 22 June 2004 the European Court of Human Rights held, unanimously, that this violated Article 3 of Protocol No. 1 and Article 14 taken together with Article 3 of Protocol No. 1.

Legal analysis

The European Court of Human Rights found, in Aziz v. Cyprus (2004), a violation of Article 3 of Protocol No. 1 and of Article 14 taken together with Article 3 of Protocol No. 1, arising from the Republic of Cyprus's refusal to register Mr Aziz on the electoral roll for the 2001 parliamentary election.
